Terms of Service
Last updated October 2, 2026
Your photos and moments stay yours. CoMoment is early software run by one person, so read the part about backups. Using the product means agreeing to what is below.
Who runs CoMoment
CoMoment is operated by an individual, not a company, and is reachable at privacy@comoment.app. In these terms, “we” means that person and “you” means the person holding the account.
Using CoMoment means you accept these terms and the Privacy Policy. If you do not, please do not use it.
Who may use it
You must be at least 18 and able to enter a contract. CoMoment is built for parents and family, so accounts belong to adults; children do not get accounts and cannot sign in.
You may record moments about your own children, or about children you are responsible for. If you add a photo of someone else's child, or share one — through an album or a link — that is your call to make and your responsibility — please have the permission you would want someone to have from you.
Your account
Signing in uses a one-time link or code sent to your email address, so whoever can read that inbox can reach your account. Keep it secure. Tell us promptly if you think someone else has gotten in.
Moments belong to a family rather than to one person, so anyone you add to your family can see and, depending on their role, change what is in it. Choose who you add accordingly.
Your content stays yours
The photos, videos, notes, places, and everything else you add remain yours. We claim no ownership of them.
To run the product we need narrow permission to handle them: to store them, to make the smaller copies the map and the timeline display, to transmit them to you, to people you have added to an album, and to anyone who opens a link you created, and to back them up. That permission exists only to operate CoMoment for you, it is not transferable to anyone else, and it ends when you delete the content or your account. We do not use your content to advertise, and we do not use it to train AI models.
What you agree not to do
- Upload anything unlawful, or any sexualized depiction of a child. This is the one line where we will act immediately and report where the law requires it.
- Upload content you have no right to, or that infringes someone else's rights.
- Use CoMoment to harass, stalk, or track another person.
- Try to reach families or albums you were not given access to, probe the service for weaknesses, or work around the limits on your plan.
- Resell the service, or use it to build a competing product from our data.
- Automate access in a way that degrades the service for other families.
If you find a security flaw, please write to us before telling anyone else. We will not pursue you for reporting one in good faith.
Sharing
Albums and moments are private until you share them. You can add someone to an album by email address at the permission you pick, or create an invite link: anyone who opens it sees a short preview of the album, and anyone who signs in through it joins as a viewer. You can also send a private link to one moment, a place's moments, or a selection, which opens without an account.
You can remove anyone's access to an album, and turn off any link you made, at any time. Turning off an invite link stops new people joining; people who already joined keep access until you remove them. Links also expire on their own — after 30 days unless you choose a longer period, and never later than 90.
A link works for whoever holds it, so treat it the way you would a house key: anyone you forward it to, and anyone they forward it to, can open it until it expires or you turn it off. Turning a link off closes the page immediately, but a photo someone already opened through it can keep loading for up to a week. And what a person does with what they can see is beyond our control — anyone who can view a photo can save it or photograph their screen. Share the way you would hand someone a printed album.
Anyone who joins an album you shared is bound by these terms too.
Storage and plans
Every family has a plan that sets how much it can store and how large a single video may be. The Free plan is 5 GB, with videos up to 50 MB and three minutes each. Photos and videos count at their original size; the smaller copies CoMoment generates are free.
Nothing you have is deleted for being over a limit. A family that reaches its quota keeps everything it has and can still view, share, and export it — it simply cannot add more until it makes room.
CoMoment does not charge anything today and has no payment method on file for anyone. If paid plans arrive, we will say so before they apply to you, and the free plan will not shrink underneath a family already using it.
Early test, backups, and risk of data loss
CoMoment is early test software in beta, run by one person and offered for evaluation. It is not a production-grade storage, backup, or archival service. Features may change or be removed, screens may move, and there will be bugs. The service or any part of it may be slow or unavailable at times, planned or otherwise.
Keep independent, current copies of every photo, video, note, and other item that matters to you. CoMoment should never be the only place a photograph of your child or any other important content exists.
We take care with your data and maintain protective and recovery measures, but those measures are not a guarantee. Content may be corrupted, become unavailable, or be permanently lost, including because of bugs, outages, hardware or provider failures, account actions, or a failure of our backup or recovery processes. A backup may be incomplete or may not restore a particular item. You are responsible for maintaining your own copies and for checking that they can be opened. To the fullest extent the law allows, you assume these risks when you use the beta.
Ending it
You can stop using CoMoment whenever you like, and delete your account and its contents from your profile. The deletion becomes permanent seven days after you ask. If it was a mistake, write to privacy@comoment.app from the address you sign in with before then; the albums you shared and the links you made do not come back.
We may suspend or close an account that breaks these terms, or where we are required to. Except where something unlawful is involved, we will tell you, and give you a chance to get your content out first.
Disclaimers and liability
CoMoment is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that content will never be lost.
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost or corrupted data or content, lost profits, or the cost of substitute services, including losses caused by a service interruption or a failed backup or recovery attempt. Where liability cannot be excluded, it is limited to the greater of the amount you paid us in the twelve months before the claim, or US$50 — and today that amount is nothing, because CoMoment is free.
Nothing in these terms excludes or limits liability that the law does not allow us to exclude or limit. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.
Governing law
These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Disputes go to the state or federal courts located in California, and you and we each consent to that. Nothing here takes away a right you have under the consumer protection law of the place you live.
Changes to these terms
If these terms change materially, we will tell you in the product before the change takes effect rather than only editing this page. Continuing to use CoMoment afterwards means accepting the new version.
